Welcome to NailDesk ("the Platform", "we", "us", or "our"). By accessing or using our software-as-a-service application, website, and integrated WhatsApp booking automation features, you ("the User", "the Merchant", or "the Client") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

1. Description of Service

NailDesk provides a B2B2C business management and booking automation platform for nail technicians and beauty professionals. Services include React-based management dashboards, scheduling calendars, customer relationship features, and WhatsApp Business API integrations for automated booking notifications.

2. Account Registration and Security

• To use the Platform, you must register an account providing accurate, current, and complete information.
• You are responsible for safeguarding your account credentials, including any API keys or passwords.
• You must immediately notify us of any unauthorized use or security breach of your account.

3. Payment Terms and SaaS Subscription

• Certain features of the Platform are provided on a paid subscription basis. By subscribing, you agree to pay all applicable recurring fees.
• Payments are processed via secure third-party payment gateways (e.g., PayFast, Paystack, Ozow).
• Failure to clear subscription fees may result in immediate suspension or termination of your access to the dashboard and automated services.

4. Acceptable Use and Restrictions

You agree not to:

• Use the automated WhatsApp integration to send spam, unsolicited marketing messages, or content that violates Meta's WhatsApp Business Policy.
• Modify, disrupt, intercept, or hack the Platform's infrastructure or API payloads.
• Reverse-engineer or attempt to extract the source code of our backend microservices.

5. Limitation of Liability

To the maximum extent permitted by applicable law, NailDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or system downtime resulting from your use or inability to use the Platform.

6. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

NailDesk is developed, owned, and operated by a privately registered company in the Republic of South Africa, with headquarters in Midrand, Gauteng. The company operates in accordance with the Companies and Intellectual Property Commission (CIPC). Registration documentation and corporate details are available upon official request.
